This English version of the General Terms and Conditions of Use is provided for convenience and informational purposes only. In case of any discrepancy, inconsistency, or conflict between this translation and the original French version, the French version shall prevail and be the only legally binding text.
Article 1 – Purpose
These General Terms and Conditions of Use (hereinafter “GCU”) govern access to and use of the ContentCrea.com website (the “Website”), made available to professionals.
The use of the ContentCrea SaaS Service is governed by the General Terms and Conditions of Sale and Use (GTC/GU – SaaS). In case of any contradiction, the GTC/GU SaaS shall prevail.
Article 2 – Access to the Website
The Website is accessible 24 hours a day, 7 days a week, except in cases of force majeure within the meaning of Article 1218 of the French Civil Code, or interruptions for maintenance.
The User is solely responsible for the technical means required to access the Website (equipment, connection, software).
Article 3 – Intellectual Property
The Website and all of its elements (texts, graphics, logos, images, software, etc.) are protected by the French Intellectual Property Code (Articles L.111-1 et seq.).
ContentCrea grants the User a limited, non-exclusive, and non-transferable license for use strictly in accordance with the intended purpose of the Website.
Any reproduction, representation, adaptation, or distribution without the prior written consent of ContentCrea is prohibited (Article L.122-4 IPC).
Article 4 – Prohibited Conduct
The User shall refrain from:
- carrying out reverse engineering, hacking, or any attempt at unauthorized access (Article L.335-3 IPC);
- disrupting the functioning of the Website (e.g., introducing viruses, overloading the infrastructure);
- uploading or publishing unlawful content within the meaning of Article 6-I-7 of French Law n°2004-575 of 21 June 2004 on Confidence in the Digital Economy (LCEN);
- infringing the rights of third parties (intellectual property rights, privacy rights, personal data rights);
- creating or disseminating content inciting hatred, violence, or discrimination, as prohibited under Article 24 of the French Law of 29 July 1881 on the freedom of the press and Article 225-1 of the French Criminal Code.
Any breach may give rise to civil and/or criminal liability for the User.
Article 5 – Personal Data
ContentCrea processes personal data in compliance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the amended French Data Protection Act n°78-17 of 6 January 1978.
The User has the rights of access, rectification, erasure, objection, restriction, and portability (Articles 15 to 22 GDPR).
For further information, the User is invited to consult the Privacy Policy available on the Website.
Article 6 – Amendments to the GCU
ContentCrea may amend these GCU at any time.
Amendments will be notified to the User by any appropriate means and published on the Website. They take effect immediately upon publication on the Website. The User is deemed to accept them by continuing to browse the Website.
In the event of a contradiction, the GTC/GU SaaS shall prevail.
Article 7 – Governing Law and Jurisdiction
These GCU are governed by French law.
Any dispute relating to their validity, interpretation, or performance shall fall under the exclusive jurisdiction of the Commercial Court of Lyon, notwithstanding multiple defendants or third-party claims.
